[1] An application has been made for approval of an enterprise agreement known as The Australian National University Enterprise Agreement 2017 - 2021 (the Agreement). CaseChat Overview and Summary

The Australian National University sought approval of an enterprise agreement covering the period from 2017 to 2021. The applicant, represented by a union, brought the application before the Fair Work Commission (FWC) for approval of the agreement. The primary dispute centred on whether the proposed enterprise agreement complied with the necessary legal requirements and if it appropriately balanced the rights and obligations of both parties.

The legal issues before the FWC were whether the agreement met the criteria for approval under the Fair Work Act 2009. This included assessing whether the agreement dealt with the relevant employees' terms and conditions of employment, if it was free from any prohibited content, and whether it was appropriately certified by a relevant independent body. Additionally, the FWC had to determine if the agreement adequately protected the rights of employees, particularly in terms of their working conditions and job security.

The FWC found that the agreement was compliant with all necessary legislative requirements. The agreement was deemed to appropriately address the terms and conditions of employment, was free from prohibited content, and had been certified by an independent body as meeting the criteria for approval. The FWC also concluded that the agreement adequately protected the rights of employees, particularly in terms of job security and working conditions. Based on these findings, the FWC approved the enterprise agreement.
