Thamvarokun (Migration)

The Administrative Appeals Tribunal (AAT) considered the application of Mr Thamvarokun for review of a decision by the Minister to refuse to grant him a Student (Temporary) (Class TU) visa, subclass 500 (Student). The refusal was based on the applicant's failure to satisfy the English language proficiency requirement.

The primary legal issue before the Tribunal was whether Mr Thamvarokun had successfully completed a substantial component of a course of study or a principal course of study that was taught in English, as evidenced by his IELTS test results. The Tribunal was required to determine if the evidence presented met the criteria stipulated in the relevant migration regulations for demonstrating English language proficiency.

In reaching its decision, the Tribunal analysed the applicant's IELTS test results in conjunction with the requirements of the Migration Regulations 1994. The Tribunal found that the applicant's IELTS scores did not meet the specified band score required to demonstrate English language proficiency for the purpose of the visa application. Consequently, the Tribunal affirmed the delegate's decision to refuse the visa.
