[1] An application has been made for approval of an enterprise agreement known as the Geofabrics Australasia Pty Ltd Albury Manufacturing Union Collective Agreement, 2014 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). The agreement is a single-enterprise agreement.

CaseChat Overview and Summary
The central legal issue before the court was whether the collective agreement satisfied the necessary criteria for approval as prescribed by the Fair Work Act. This involved examining the agreement's compliance with the statutory requirements, including whether it addressed minimum terms and conditions of employment, and whether it was free from prohibited content. Additionally, the court needed to assess whether the agreement was made in good faith and whether it provided for a genuine bargaining process.
Commissioner D.C. Johnson found that the collective agreement met all statutory requirements for approval. The Commissioner noted that the agreement contained all the prescribed minimum terms and conditions, was free from prohibited content, and had been negotiated in good faith. Furthermore, the Commissioner was satisfied that the bargaining process was genuine, as evidenced by the union's and the employer's engagement in discussions and negotiations. As a result, the application for approval was successful.
The Fair Work Commission approved the Geofabrics Australasia Pty Ltd Albury Manufacturing Union Collective Agreement, 2014, effective from the date of the decision. The Commissioner's decision was based on the agreement's compliance with the statutory requirements and the genuineness of the bargaining process. The approval ensures that the terms and conditions outlined in the agreement are legally binding on the parties involved.
