The Tribunal found that TCVR suffered from several accepted medical conditions, including a mental health condition, spinal disorder, lower limb deficiency, upper limb deficiency, and a kidney disorder, thus satisfying section 94(1)(a). Applying the Impairment Tables, the Tribunal determined that TCVR's chronic depression and anxiety attracted 10 points under Table 5 (Mental health function), his spinal condition attracted 10 points under Table 4 (Spinal function), and his left knee condition attracted 5 points under Table 3 (Lower limb deficiency). This cumulative total of 25 points exceeded the 20-point threshold. Furthermore, the Tribunal was satisfied that TCVR had a continuing inability to work.

Consequently, the Tribunal set aside the decision under review and substituted a new determination. It found that TCVR satisfied all the requirements of section 94 of the Social Security Act 1991 and was therefore qualified for the Disability Support Pension as at the date of his claim.
