Taro and Sanders

In the matter of *Taro and Sanders*, heard by Baumann J, the dispute concerned the living arrangements for a child born in 2014. The court was required to determine the primary residence of the child and to make orders regarding the child's care and the parents' future interactions.

The central legal issues before the court were: (a) with which parent the child should live; (b) whether the child should be released from Child Dispute Services into the care of a parent; (c) the father's entitlement to enrol the child in kindergarten; and (d) whether an injunction should be granted restraining the mother from approaching the child.

Baumann J ordered that the child live with the father immediately and be released from Child Dispute Services into the father's care. The father was granted the right to choose and enrol the child in kindergarten, with details to be provided to the mother. Crucially, pursuant to section 68B of the *Family Law Act 1975*, an injunction was issued restraining the mother from approaching the child in any setting, including her residence, kindergarten, or public places. The proceedings were adjourned for a Case Management Hearing.
