The Administrative Appeals Tribunal considered an application for a Student (Temporary) (Class TU) visa, Subclass 500 (Student), concerning studies in cookery, hospitality, and business. The applicant had provided evidence of Overseas Student Health Coverage and a Certificate of Enrolment.

The Tribunal was required to determine whether the applicant met the relevant criteria for the Subclass 500 visa, specifically clauses 500.211, 500.215, and 500.311 of Schedule 2 to the Regulations.

The Tribunal found that the applicant met certain criteria but that other criteria remained to be considered. Consequently, the Tribunal remitted the application to the Minister for reconsideration, directing that the applicant and any secondary applicants be assessed against the specified clauses of Schedule 2 to the Regulations.
