Tamati (Migration)

The Administrative Appeals Tribunal (AAT) considered the matter of an applicant, Tamati, concerning the cancellation of his Special Category (Temporary) (Class TY) visa, Subclass 444. The dispute arose from an application for review of this cancellation, which the Tribunal found to be lodged out of time.

The primary legal issue before the Tribunal was whether it possessed jurisdiction to consider the applicant's review application, given that the applicant had previously indicated a desire to withdraw that application.

The Tribunal noted that on 9 May 2018, the applicant had sent an email to the Tribunal expressing his wish to withdraw his application for review. Based on this communication, the Tribunal concluded that it did not have jurisdiction to proceed with the matter. The Member, Tigiilagi Eteuati, therefore made a decision to that effect.
