The Administrative Appeals Tribunal considered an application for a Subclass 500 (Student) visa made by a 32-year-old applicant from Nepal. The applicant also presented evidence of her husband and child remaining in Nepal, and her employment history in Nepal. However, the Tribunal found that further consideration was needed regarding the applicant's genuine temporary entrant status. The Tribunal concluded that the matter should be remitted for further consideration by the Minister.

Consequently, the Tribunal remitted the application for a Student (Temporary) (Class TU) visa for reconsideration, with a direction that the applicant meets the criteria specified in clause 500.212(a) of Schedule 2 to the Regulations.
