Talacko v Bennett

The High Court reasoned that section 58(3) of the *Bankruptcy Act 1966* (Cth) imposes a statutory stay on the enforcement of judgments against a bankrupt, irrespective of whether the judgment creditor has taken any steps to enforce the judgment. This statutory stay is a "stay of enforcement of the judgment" for the purposes of section 15(2) of the *Foreign Judgments Act 1991* (Cth). Consequently, an application for a certificate under section 15(1) cannot be made while the judgment debtor remains bankrupt, as the statutory stay remains in effect. The Court allowed the appeal, set aside the orders of the Court of Appeal of the Supreme Court of Victoria, and dismissed the respondents' appeal to that court.
