While the Tribunal accepted the Philippine account balance as current, it found that these funds, along with the tuition fees already paid, were insufficient to meet the total financial requirements for her intended stay and study. The applicant herself acknowledged that she could not meet the required financial criteria but expressed a strong desire to continue her studies. Applying the principles of cl.500.214, the Tribunal concluded that the applicant had not demonstrated genuine access to sufficient funds.
Consequently, the Tribunal was not satisfied that the applicant met the financial capacity requirements of cl.500.214. As this was a criterion for the grant of a Subclass 500 (Student) visa, and the applicant did not claim to meet the criteria for any other visa class, the Tribunal affirmed the decision not to grant the visa.
