CaseChat Overview and Summary
The appellant, a citizen of Nepal, appealed a decision of the Tribunal which dismissed his application for a protection visa. The appellant arrived in Australia in December 2005 and applied for a protection visa on 9 February 2006. The application was refused on 8 May 2006 by a delegate of the Minister for Immigration and Citizenship. The Tribunal dismissed the appellant’s review application on 24 May 2006. The appellant sought review of the Tribunal’s decision by the Federal Magistrates Court. The central issue in the case was whether the Tribunal erred in dismissing the appellant’s application for a protection visa. The appellant claimed he feared persecution in Nepal because of his imputed political opinion as a Maoist and his previous involvement with the Nepal Communist Party (United Marxist-Leninist). He also claimed to fear persecution from the Maoists because he refused to give them donations and from Hindu extremists due to his conversion from Hinduism to Christianity. The court had to determine whether the Tribunal correctly evaluated the evidence and whether the appellant’s claims of persecution were well founded. The Federal Magistrates Court held that the Tribunal did not err in dismissing the appellant’s application. The court found that the Tribunal’s assessment of the evidence was reasonable and that the appellant’s claims were not credible. The court accepted the Tribunal’s findings that the appellant’s claims were inconsistent and that he could not demonstrate a real chance of persecution if returned to Nepal. The court held that the Tribunal’s conclusion that the appellant’s fear of persecution was not well founded was supported by the evidence.
