SZJIK & Anor v MIAC & Anor

SZJIK and another (the applicants) sought judicial review of decisions made by the Minister for Immigration and Citizenship (the Minister) and the Migration Agents Registration Authority (the Authority). The applicants were registered migration agents who had their registrations cancelled by the Authority, a decision affirmed by the Minister on review. The applicants challenged these decisions in the High Court of Australia.

The central legal issue before the High Court was whether the Minister, in affirming the Authority's decisions to cancel the applicants' registrations, had failed to afford them procedural fairness. Specifically, the applicants contended that the Minister had relied on adverse information not previously disclosed to them, and that they were not given an adequate opportunity to respond to this information before the Minister made his decision.

Gummow and Kiefel JJ held that the Minister's decision-making process did not breach the requirements of procedural fairness. Their Honours reasoned that the Minister's review was not a de novo hearing but a review of the Authority's decision. The adverse information relied upon by the Minister was information that had been before the Authority during its original consideration of the matter, and which the applicants had had an opportunity to address at that stage. The Court found that the Minister was entitled to consider this material in his review and that the applicants had not been denied a fair opportunity to present their case.

The applications for judicial review were dismissed.
