Sydney Sterile Compounding Pty Ltd and Minister for Health [2016] AATA 743 [2016] AATA 743 26 September 2016

CaseChat Overview and Summary

Sydney Sterile Compounding Pty Ltd ("Sydney Sterile") sought to set aside six summonses issued at the request of the Minister for Health. The substantive dispute concerned Sydney Sterile's application for a licence to import drugs, specifically Cannabidiol, and the Minister's refusal of that application on the grounds that the principal of Sydney Sterile, Mr Ian Abrams, was not a fit and proper person to hold such a licence. Sydney Sterile had challenged this decision and sought a review of the Minister's decision.

The primary legal issue before the Tribunal was whether the summonses, which sought various documents relating to Mr Abrams' conduct as a pharmacist and in connection with importing, handling, or storing chemicals, as well as documents concerning Maroubra Pharmacy, were valid. Sydney Sterile argued that the documents sought by the summonses were too broad and did not sufficiently relate to the central issue of Mr Abrams' fitness to hold a licence.

The Tribunal applied the established legal test for the validity of summonses, which requires that the documents sought could "reasonably be expected to throw light on some of the issues in the principal proceedings." The Tribunal considered that the core of the proceedings was Mr Abrams' fitness to hold a licence. Despite Sydney Sterile's submissions that certain paragraphs of the summonses were remote or overly broad, the Tribunal found that the summonses were limited in time and scope and were relevant to determining Mr Abrams' fitness.

Consequently, the Tribunal dismissed Sydney Sterile's application to set aside the summonses and upheld their validity.
