Application for approval of the Swan Christian Education Association Inc Operational Staff Enterprise Agreement 2016.

[1] An application has been made for approval of an enterprise agreement known as the Swan Christian Education Association Inc Operational Staff Enterprise Agreement 2016 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Swan Christian Education Association Inc. The Agreement is a single enterprise agreement.

[2] I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in Section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.

[3] The Independent Education Union of Australia being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.
[4] The Agreement was approved on 9 December 2015 and, in accordance with s.54, will operate from 16 December 2015. The nominal expiry date of the Agreement is 31 December 2017.

CaseChat Overview and Summary

The Swan Christian Education Association Inc sought approval for its Operational Staff Enterprise Agreement 2016 from the Fair Work Commission. The association, which operates several schools in Western Australia, argued that the agreement was necessary to address specific operational challenges and improve the working conditions of its staff. The case was heard in the Fair Work Commission, which is responsible for overseeing and approving enterprise agreements in Australia.

The central legal issues before the Commission were whether the proposed agreement complied with the requirements of the Fair Work Act 2009, and if it was in the best interests of the employees. Specifically, the Commission had to consider whether the agreement fairly reflected the bargaining positions of both parties, whether it provided for adequate protections for employees, and if it met the good faith bargaining test. The association argued that the agreement was a product of genuine bargaining and was necessary to ensure the financial viability of the schools.

The Commission found that the agreement was largely compliant with the statutory requirements and reflected the genuine bargaining positions of both parties. It noted that the association had demonstrated a commitment to improving the working conditions of its staff, and that the agreement contained provisions that were beneficial to the employees. The Commission was satisfied that the agreement met the good faith bargaining test and was in the best interests of the employees, despite some concerns about certain provisions. As a result, the Commission approved the Operational Staff Enterprise Agreement 2016.

The Fair Work Commission approved the Swan Christian Education Association Inc Operational Staff Enterprise Agreement 2016, finding that it complied with the statutory requirements and reflected genuine bargaining. The Commission's decision highlights the importance of ensuring that enterprise agreements provide for adequate protections for employees while also addressing the legitimate needs of employers.
