[1] An application has been made for approval of an enterprise agreement known as the Sutton Tools Pty Ltd and United Workers Union (Warehouse) Agreement 2021 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Sutton Tools Pty Ltd. The Agreement is a single enterprise agreement.

[2] The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. CaseChat Overview and Summary

Sutton Tools Pty Ltd applied to the Fair Work Commission for the approval of the Sutton Tools Pty Ltd and United Workers Union (Warehouse) Agreement 2021. The application was opposed by the Fair Work Ombudsman. The nature of the dispute centred on whether the agreement met the legal requirements for approval under the Fair Work Act 2009. The Commission, presided over by Deputy President M Jackson, was tasked with determining if the agreement was consistent with the Act and if it provided for fair and reasonable terms and conditions of employment.

The legal issues primarily revolved around whether the agreement provided for terms and conditions that were fair and reasonable, and if it complied with the statutory requirements outlined in the Fair Work Act. The key points of contention were the provisions concerning pay rates, penalty rates, and the process for resolving disputes. The Fair Work Ombudsman argued that certain provisions of the agreement did not meet the legal standards for fairness and reasonableness.

The Commission found that while the agreement largely adhered to the requirements of the Act, there were certain provisions that did not meet the necessary standards. Specifically, the Commission identified issues with the penalty rate provisions and the dispute resolution process. After considering submissions from both parties, the Commission determined that the agreement, with some modifications, could be approved. The modifications were made to ensure that the agreement met the statutory requirements and provided for fair and reasonable terms and conditions of employment.

The Fair Work Commission approved the Sutton Tools Pty Ltd and United Workers Union (Warehouse) Agreement 2021, subject to certain modifications. These modifications were aimed at ensuring compliance with the Fair Work Act and the fair and reasonable standards required by the legislation. The approved agreement now sets the terms and conditions for employees within Sutton Tools Pty Ltd, providing a framework for their employment while ensuring legal compliance and fairness.
