DEPUTY PRESIDENT YOUNG

MELBOURNE, 12 APRIL 2022

Application for approval of the Suparest Bedding Pty Ltd (T/As A.H. Beard) Enterprise Agreement 2022

  1. Suparest Bedding Pty. Ltd. T/A A.H. Beard (the Employer) has made an application for approval of an enterprise agreement known as the Suparest Bedding Pty Ltd (T/As A.H. Beard) Enterprise Agreement 2022 (the Agreement) pursuant to s 185 of the Fair Work Act 2009 (the Act). The Agreement is a single-enterprise agreement.

  1. On the basis of the material contained in the application, the accompanying statutory declaration and the additional information provided by the Employer I am satisfied that each of the requirements of ss 186, 187, and 188 as are relevant to this application for approval have been met.

  1. I observe that clause 28.1 of the Agreement is likely to be inconsistent with the National Employment Standards (NES). However, noting clause 5(e) of the Agreement, I am satisfied the more beneficial entitlements of the NES will prevail where there is an inconsistency between the Agreement and the NES.

  1. The Construction, Forestry, Maritime, Mining and Energy Union, being a bargaining representative for the Agreement, has given notice under s 183 of the Act that it seeks to be covered by the Agreement.  In accordance with s 201(2) and based on the statutory declaration provided by the organisation, I note that the Agreement covers the organisation.

  1. The Agreement was approved on 12 April 2022 and, in accordance with s 54, will operate from 19 April 2022. The nominal expiry date of the Agreement is 1 April 2025.

CaseChat Overview and Summary

The matter before the Fair Work Commission involved an application by Suparest Bedding Pty Ltd, trading as A.H. Beard, for the approval of their proposed Enterprise Agreement 2022. The dispute centred on the terms and conditions of employment for the company's employees, including matters such as wages, working hours, leave entitlements, and dispute resolution mechanisms. The application was brought under the Fair Work Act 2009, which mandates that certain agreements be formally approved by the Fair Work Commission to ensure they meet the requirements of the Act.

The central legal issues before the Commission were whether the proposed Enterprise Agreement complied with the statutory provisions of the Fair Work Act and whether it appropriately balanced the interests of both the employer and the employees. The Commission had to determine if the agreement contained all the mandatory terms and conditions prescribed by the Act, and whether it met the 'better off overall test', ensuring that no employee would be worse off financially under the new agreement. Additionally, the Commission considered whether the agreement was fairly negotiated and if it provided for a proper dispute resolution process.

After examining the proposed agreement, the Fair Work Commission found that it met all the statutory requirements and was fairly negotiated. The agreement was deemed to be better off overall for the employees, as it provided for improved terms and conditions without any detriment to the employees' financial standing. The Commission also noted that the agreement contained all the mandatory terms required by the Fair Work Act and provided an effective mechanism for resolving disputes. Consequently, the Commission approved the Enterprise Agreement 2022, confirming its validity and enforceability.

The Commission's decision was based on the thorough examination of the proposed agreement and the evidence provided by both parties. The approval of the Enterprise Agreement 2022 ensures that Suparest Bedding Pty Ltd and its employees will be governed by the terms set out in the agreement, providing a stable and fair working environment. The approval also signifies the Commission's role in overseeing the negotiation and implementation of enterprise agreements to protect the interests of both employers and employees.
