As the applicant had not demonstrated compelling circumstances to justify a waiver, and had failed to meet the identity criteria, the Tribunal concluded that the applicant did not meet the requirements for the visa.
Consequently, the Tribunal affirmed the decision not to grant the applicant the Student (Temporary) (Class TU) visa.
