CaseChat Overview and Summary
The legal issues before the Commission were whether the proposed agreement included all the required terms, whether the agreement provisions were consistent with the Act, and whether the agreement was fairly negotiated. The Commission had to consider the specific provisions of the agreement, the national employment standards, and the relevant provisions of the Act. The Commission also had to assess whether the agreement was negotiated in good faith and whether it was fair and reasonable.
The Fair Work Commission found that the agreement included all the required terms and was consistent with the national employment standards and the Act. The Commission also found that the agreement was fairly negotiated, taking into account the bargaining positions of the parties and the nature of the enterprise. The Commission approved the agreement, finding that it was fair and reasonable and met the requirements of the Act.
The Commission made orders approving the Summer Hill Aged Care Service - Nursing Home Pty Ltd 2017 Enterprise Agreement. The approved agreement will now be registered with the Fair Work Commission and will apply to the employees covered by the agreement.
