Stork Technical Services Pty Ltd applied to the Federal Circuit Court of Australia for the approval of an enterprise agreement with its employees. The agreement, known as the Stork Technical Services Australia Pty Ltd Ichthys Onshore Construction Greenfields Agreement, was contested by a union representing some of the employees. The court was required to determine if the agreement complied with the provisions of the Fair Work Act 2009 and if it was made in good faith.

The court examined several aspects of the agreement to ascertain its compliance with the Act. These included whether the agreement provided for fair remuneration and conditions, if it allowed for the proper operation of businesses, and if it contained appropriate dispute resolution mechanisms. Additionally, the court considered if the agreement had been made in good faith, which required an examination of the bargaining process and the parties' conduct.

In its decision, the court found that the agreement was compliant with the Act and had been made in good faith.
