Stocks and Allen

In *Stocks and Allen*, Forrest J of the Federal Circuit Court of Australia considered applications made by the parties in their property settlement proceedings. The wife had filed an application on 21 August 2015, which the court ultimately dismissed.

The court was required to determine the wife's application and to manage the progression of the competing substantive applications for property adjustment orders. Further, the court needed to address the immediate financial obligations of the parties' self-managed superannuation fund, including outstanding auditor fees and property rates, and to facilitate the sale of a property held by the fund.

Forrest J ordered that the wife's application be dismissed and that the hearing of the substantive property adjustment applications be expedited. The court directed that the parties take all necessary steps to ensure payment of outstanding auditor fees and property rates for their self-managed superannuation fund, and to list a property held by the fund for sale by open listing at an agreed price. The proceedings were listed for further mention on 15 October 2015 for trial listing and directions. All other interim applications were dismissed.
