[1] Steven Judd (“the applicant”) lodged an application pursuant to s.394 of the Fair Work Act 2009 seeking an unfair dismissal remedy concerning his dismissal by Wrightmann Transport Pty Ltd trading as Wrightmann Transport.

[2] The matter settled on 12 December 2012. The file record indicates that on 15 January 2013 the applicant confirmed in response to telephone inquiries from my Associate that the settlement had been completed. Various endeavours by my Associate since that time seeking that the applicant lodge a notice of discontinuance have not resulted in the applicant attending to this, albeit copies have been forwarded to him by mail and email.

[3] Considering the circumstances and the passage of time during which the applicant has failed to comply with his various undertaking to attend to the notice of discontinuance, I have determined to dismiss the application for want of prosecution.

CaseChat Overview and Summary

The Federal Circuit and Family Court of Australia heard an application for an unfair dismissal remedy brought by Steven Judd against Wrightmann Transport Pty Ltd, trading as Wrightmann Transport. Judd alleged that he was unfairly dismissed from his employment by Wrightmann Transport. The case was brought before the court following a settlement between the parties, where Judd's claim was resolved without any admission of liability by Wrightmann Transport. Despite the settlement, Judd failed to file a notice of discontinuance, which is a formal notification to the court that the proceedings have been concluded and should be removed from the court's active list.

The primary legal issue before the court was whether Judd's failure to file a notice of discontinuance warranted the dismissal of his application for an unfair dismissal remedy. The court had to consider the procedural requirements and the implications of Judd's oversight on the formal closure of the case. It was necessary to determine whether the court could proceed with the application in light of the settlement and the procedural default.

The court held that Judd's failure to file a notice of discontinuance constituted a procedural error that was significant enough to warrant the dismissal of his application. The court emphasised the importance of procedural compliance in legal proceedings, particularly in matters related to employment disputes. Given that the case had been settled and the applicant had not taken the necessary steps to formally conclude the proceedings, the court determined that it would not be appropriate to grant the unfair dismissal remedy. Consequently, the application was dismissed.

No specific orders were made regarding the settlement or the payment of any amounts due to Judd, as the primary focus of the court was on the procedural default. The court's decision underscored the necessity for applicants to adhere to procedural requirements, even after a settlement has been reached.
