CaseChat Overview and Summary
The Statute Law Amendment Act 2018 (ACT) (the Act) amends a number of existing Acts to improve the quality of the statute law of the Territory by amending legislation for the purpose of statute law revision. The Act amends 11 Acts and repeals one regulation. The Ombudsman Act 1989 (Ombudsman Act) is amended to allow the ombudsman to delegate functions to a deputy ombudsman, the ombudsman's staff, an authorised person or any other person. The Act also allows the ombudsman to make arrangements with the head of service to use the services of an ACT public servant or Territory facilities and to engage contractors and consultants. The Public Health Act 1997 is amended to update references to 'authorised nurse practitioner' to reflect the changed regulatory scheme for nurse practitioners under the Health Practitioner Regulation National Law (ACT). The Public Sector Management Act 1994 is amended to give a public sector employer the power to delegate a function to a public employee or another person. The Workers Compensation Act 1951 is amended to reinstate an entitlement to compensation for workers of pension age or older who are incapacitated because of a compensable injury. The Act also amends the Road Transport (Alcohol and Drugs) Act 1977 to update references to 'authorised nurse practitioner' to reflect the changed regulatory scheme for nurse practitioners under the Health Practitioner Regulation National Law (ACT). The Act includes amendments to a number of Acts to update references to the Commonwealth Department of Immigration and Border Protection as the Department of Home Affairs. The Health Regulation 2004 is repealed as nurse practitioners have been regulated under the Health Practitioner Regulation National Law (ACT) since 2010. The Legislative Assembly passed the Act on 30 October 2018.
