The Court of Appeal had held that the State Rail Authority could only rely on defences available to it in its own right and did not inherit the defences that the Public Transport Commission would have had against the respondent. This conclusion was based on the interpretation that clause 3(1)(h) did not provide for the transmission of such accrued defences to the State Rail Authority. The court reasoned that if the remedy was extinguished by section 29(5) of the Public Transport Commission Act, and this defence was not transferred to the State Rail Authority, then the Authority could not plead it. The application for special leave to appeal was heard on 15 September 1989.
