The Court noted that while the *Limitation Act 1969* (NSW) introduced a discoverability element for certain personal injury claims under section 11, this did not extend to the specific provision in section 14(1)(b) which deals with the accrual of a cause of action for the purposes of the six-year limitation period.

The High Court allowed the appeal, setting aside the orders of the Court of Appeal and remitting the matter to the Supreme Court of New South Wales for determination of the remaining issues.
