CaseChat Overview and Summary
The Commission carefully examined the submissions from both parties, considering the specific clauses of the agreement in question and relevant legislative provisions. It assessed whether the agreement provided for the appropriate terms and conditions of employment and whether it adhered to the requirements of the Fair Work Act. The Commission also considered whether the agreement was made in good faith and whether it was fair and reasonable. After thorough analysis, the Commission determined that the agreement complied with the Act and was in line with the principles of good faith bargaining and fairness.
As a result, the Fair Work Commission approved the Starick Services Incorporated Collective Enterprise Agreement 2016. This decision recognised the agreement as legally binding and enforceable, thereby providing a framework for the employment terms and conditions of the employees involved.
