CaseChat Overview and Summary

St John Ambulance Western Australia Limited applied to the Fair Work Commission for approval of the St John Ambulance Western Australia Ltd Ambulance Officers' / Paramedics Enterprise Agreement 2024. The dispute centred on whether the proposed agreement met the legal requirements for approval under the Fair Work Act 2009. The Commission, presided over by Commissioner D.J. Gray, had to determine if the agreement satisfied the criteria for genuine bargaining and if it was in the best interests of the employees.

The primary legal issue was whether the agreement had been genuinely bargained for and reflected the independent wishes of the parties. The Commission examined whether the process leading to the agreement was free from any undue influence or coercion and whether it had been negotiated in good faith. Additionally, the Commission had to assess if the agreement contained all the prescribed minimum terms and conditions as mandated by the Fair Work Act.

The Fair Work Commission found that the agreement had been genuinely bargained for, as it was the product of negotiations between St John Ambulance Western Australia Limited and the union representatives in good faith. The Commission noted that the agreement covered all prescribed minimum terms and conditions and was in the best interests of the employees. The Commission concluded that the agreement met the legal requirements for approval and would provide fair and reasonable terms for the employees.

The Fair Work Commission approved the St John Ambulance Western Australia Ltd Ambulance Officers' / Paramedics Enterprise Agreement 2024, effective from 1 March 2024. The Commission's decision was based on the findings that the agreement had been genuinely bargained for, was in the best interests of the employees, and met the legal requirements for approval under the Fair Work Act 2009.
