St George Bank - a Division of Westpac Banking Corporation v Tonab Investments Pty Ltd

In the matter of St George Bank - a Division of Westpac Banking Corporation v Tonab Investments Pty Ltd, the Federal Court considered an application for an order of possession of certain land. The bank sought an order for possession of a property based on default in mortgage repayments. The respondent, Tonab Investments Pty Ltd, raised a second defence which largely repeated allegations that had been made in an earlier defence which had been struck out by the court. The central issue before the court was whether the respondent's repetition of allegations in the second defence constituted an abuse of process.

The court held that the repetition of allegations in the second defence did indeed constitute an abuse of process. The court found that the respondent had deliberately repeated the earlier defence despite it being struck out, and this conduct was an abuse of the court's process. The court noted that the respondent had ample opportunity to amend the defence and address the issues raised by the bank's application, but had chosen not to do so. The court held that this conduct was an abuse of process and an impediment to the fair and efficient administration of justice.

As a result of the abuse of process, the court dismissed the respondent's second defence and made the order for possession sought by the bank. The court ordered that the bank be granted possession of the property. Additionally, the court made orders for the payment of costs associated with the application for possession.
