CaseChat Overview and Summary
The central legal issues before the Commission were whether the agreement met the necessary criteria for approval under the Fair Work Act 2009. Specifically, the Commission needed to determine if the agreement complied with the good faith bargaining requirements, if it provided for a safety net of minimum terms and conditions, and if it contained any provisions that were contrary to public policy or unjust. The Commission also considered whether the agreement had been fairly and genuinely negotiated between the employer and the employees' representatives.
After reviewing the evidence and arguments presented by both parties, the Commission found that the proposed enterprise agreement was made in good faith, provided for a safety net of minimum terms and conditions, and did not contain any provisions that were contrary to public policy or unjust. The Commission was satisfied that the agreement had been fairly and genuinely negotiated between the employer and the employees' representatives. Consequently, the Commission approved the Spantech Pty Ltd Enterprise Agreement - 2015, effective from the date of the decision.
