The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Southern Midlands Council (the Applicant). The Agreement is a single enterprise agreement.
[2] I am satisfied that each of the requirements of ss.186, 187 and 188 are relevant to this application for approval and have been met.

In accordance with s.201(2) I note that the Agreement covers the organisation.

CaseChat Overview and Summary
The central legal issues the court had to determine were whether the agreement complied with the relevant provisions of the Fair Work Act 2009, including whether it was a "good faith" agreement and whether it met the criteria for approval under the Act. Specifically, the court had to consider whether the agreement provided for fair and reasonable terms and conditions, and whether it adhered to the principles of good faith bargaining.
The Fair Work Commission found that the proposed agreement was in good faith and met all the necessary criteria for approval. The Commission noted that the agreement had been negotiated in good faith, with both parties making genuine efforts to reach a resolution. The Commission also found that the terms and conditions of the agreement were fair and reasonable, providing adequate protections and benefits for the employees. Given these findings, the Commission approved the Southern Midlands Council Enterprise Agreement Number 11 of 2021.
