CaseChat Overview and Summary
The central legal issue was whether the proposed changes to the enterprise agreement were fair and reasonable, and if the process by which the agreement was negotiated was compliant with the relevant provisions of the Fair Work Act 2009. The Commission had to consider the fairness of the agreement's terms, the process of negotiation, and the interests of the employees.
The Commission found that the proposed changes to the enterprise agreement were fair and reasonable, and that the negotiation process was compliant with the Act. The Commission considered that the changes provided for appropriate remuneration and working conditions, and that the process of negotiation was fair and transparent. The Commission also found that the proposed changes were in the best interests of the employees, given the financial constraints faced by the Trust. The Commission approved the application, and the 2014 Outdoor Enterprise Agreement was implemented.
No further orders were made by the Commission.
