CaseChat Overview and Summary

The Administrative Appeals Tribunal considered an application for a Subclass 500 (Student) visa. The applicant, a 52-year-old woman from Korea, sought to challenge the decision to refuse her visa. The core of the dispute revolved around whether the applicant met the criteria of being a "genuine temporary entrant" for entry and stay in Australia as a student.

The Tribunal was required to determine if the applicant genuinely intended to stay in Australia temporarily, as stipulated by clause 500.212(a) of the Migration Regulations 1994. This assessment necessitated consideration of the applicant's circumstances in her home country and in Australia, her immigration history, and the value of the proposed course to her future, in accordance with Direction No. 69. The Direction also emphasised that these factors should not be treated as a checklist but rather as guides for a holistic assessment of the applicant's overall circumstances.

In its reasoning, the Tribunal noted the applicant's lengthy history in Australia, commencing in 2009 on a student guardian visa, followed by periods on student visas for various short, lower-level courses, including hairdressing and English. The Tribunal found that the applicant had not completed her initial hairdressing course and had repeatedly switched visa types. It also considered that similar courses were available in her home country and that her stated plans for future business were vague. Given the applicant's age, her extended periods of study in Australia, the nature of the courses undertaken, and the availability of comparable study options in her home country, the Tribunal concluded that the applicant had not demonstrated a genuine intention to temporarily stay in Australia for the purpose of study.

Consequently, the Tribunal affirmed the decision not to grant the applicant a Subclass 500 (Student) visa, finding that the criteria for the visa were not met.
