CaseChat Overview and Summary
The central legal issues before the Commission were whether the agreement was a "bargaining agreement" as defined in section 172 of the Act, and whether it had been "bargained for" in good faith as required by section 184. The applicant argued that the agreement was a genuine bargaining agreement, which had been negotiated in good faith, and that it met all the requirements for approval. The Commission was required to determine whether the agreement satisfied the legal criteria for approval, and if it did, whether it should be approved.
The Commission examined the evidence and submissions provided by both parties. It considered the process by which the agreement was negotiated, the parties involved, and the terms of the agreement. The Commission found that the agreement was a genuine bargaining agreement, which had been negotiated in good faith. It also found that the agreement met all the requirements for approval under the Fair Work Act. The Commission approved the agreement, finding that it was in the best interests of the employees covered by the agreement.
The Fair Work Commission approved the Solec Australia Pty Ltd Enterprise Agreement 2017 – 2021, finding that it met all the requirements for approval under the Fair Work Act. The Commission found that the agreement was a genuine bargaining agreement, which had been negotiated in good faith, and that it was in the best interests of the employees covered by the agreement. The approval of the agreement ensures that the terms and conditions of employment for the employees covered by the agreement are regulated by the agreement, rather than by the general law.
