Smith v County Court of Victoria & Primrose

Smith appealed a decision of the County Court of Victoria that had allowed an appeal from the Magistrates’ Court and varied a penalty imposed by the latter. Smith had been charged with driving with a blood alcohol concentration of 0.08 or above. The court set aside the decision of the County Court and restored the penalty imposed by the Magistrates’ Court.

The court ordered that the penalty imposed by the Magistrates’ Court be reinstated, which included the cancellation of Smith’s driver’s licence for a period of 18 months. The court also ordered that Smith pay the costs of the appeal.
