After a holistic review of the evidence, the Tribunal concluded that the Applicant's circumstances were not sufficiently special or unusual to warrant the exercise of the discretion under section 1184K.

Accordingly, the Tribunal affirmed the decision under review, finding that the compensation preclusion period was correctly applied and that no special circumstances justified treating the compensation payment as not having been made.
