He argued this had caused "excess stress and load" to the right side of his body, resulting in osteoarthritis in his right knee, right hip, and lower back, and a tear of the medial cartilage of his right knee.

The Tribunal considered extensive medical evidence, including reports from orthopaedic surgeons dating back to 1976. While it was not disputed that Mr. Slip suffered from moderate to severe osteoarthritis in his left knee, which was materially contributed to by his previous employment, the Tribunal found the medical evidence supporting his claim for secondary ailments in the right knee, right hip, and lumbosacral spine to be incomplete and unconvincing. The Tribunal noted that the opinions favouring Mr. Slip's claim relied heavily on his self-reported symptoms and intermittent radiological studies, with minimal clinical evaluation or meaningful assessment of functional impairment. The Tribunal concluded that the medical evidence did not establish a causal link between Mr. Slip's employment and the claimed secondary ailments in his right knee, right hip, and lumbosacral spine.

Consequently, the Tribunal found that, as at 30 May 2018, Comcare was not liable to pay compensation pursuant to section 16 of the SRC Act in respect of the cost of medical treatment for "osteoarthritis localised multiple sites (right)" and "tear of medial cartilage or meniscus of knee (right)". The decision under review was affirmed.
