CaseChat Overview and Summary

The case SLD v JMW involved a dispute between the parties regarding the adjustment of property interests following the termination of their de facto relationship. The relationship lasted from 2001 until late 2006, during which they had two children. The respondent made a greater financial contribution to the relationship, but the applicant contributed more to the family welfare and currently has care of the children. The primary issue before the court was to determine what constitutes a just and equitable adjustment of the parties' interests in the property.

The court considered various factors, including the length of the relationship, the financial contributions made by each party, the care of the children, and the overall welfare of the family. The court recognised the need to balance the financial contributions against the non-financial contributions made by the applicant, particularly in relation to the care of the children. The court held that the applicant's contributions to the family welfare, including the care of the children, warranted a significant adjustment in her favour.

The court ordered the respondent to pay the applicant $227,000 by a specified date. Upon payment, the applicant was to transfer her interest in the property known as the applicant's house to the respondent, and the respondent was to assume responsibility for the mortgage over that property. The respondent was also required to remove the applicant as a beneficiary of the trust and pay any outstanding rates on the applicant's house. The respondent was to retain his interest in the property known as the respondent's house and any interest in the company and Equipment and Lifting Solutions Pty Ltd, indemnifying the applicant for any related liabilities. If the respondent failed to comply with the payment order, the properties were to be sold, and the net proceeds were to be distributed accordingly. Each party was to retain their respective property free of claims from the other.
