CaseChat Overview and Summary
The Administrative Appeals Tribunal reviewed a decision concerning Skyhooks Solutions Pty Ltd's application for approval of a nomination for a position. The core of the dispute revolved around whether the applicant met the various criteria stipulated in the Migration Regulations 1994 for such a nomination, particularly concerning the terms and conditions of employment for the proposed nominee and the genuineness of the occupation.
The Tribunal was required to determine if Skyhooks Solutions Pty Ltd had satisfied all the relevant regulatory requirements for the approval of its nomination. This included assessing whether the nomination process was correctly followed, if the nominator was an approved sponsor, if the nominee was properly identified, and if the nominated occupation was specified in the relevant instruments. Crucially, the Tribunal had to consider whether the terms and conditions of employment offered to the nominee were no less favourable than those provided to an Australian citizen or permanent resident performing equivalent work, and whether the nominated position was genuine.
In its reasoning, the Tribunal systematically examined each applicable regulation. It found that the applicant had complied with the procedural requirements for making the nomination, was an approved standard business sponsor, and had correctly identified the nominee, Mr. Adam Wardle, and the nominated occupation, Painting Trades Worker (ANZSCO code 332211). The Tribunal was satisfied that the occupation was listed in the relevant instrument (IMMI 17/060) and that the terms and conditions of employment, including salary rates and adherence to the relevant award, were no less favourable than those for an Australian citizen or permanent resident. Furthermore, the Tribunal found no adverse information concerning the applicant and concluded that the nominated position was genuine.
Consequently, the Tribunal set aside the original decision not to approve the nomination and substituted a decision approving the nomination.
