CaseChat Overview and Summary

Skilled Workforce Solutions (NSW) Pty Ltd sought approval for an enterprise agreement. The dispute arose from the application for the agreement's approval and its subsequent correction. The Fair Work Commission was the court in this matter. The primary legal issue was whether the corrections to the agreement, as sought by the applicant, were appropriate and in line with the requirements of the Fair Work Act 2009.

The Commission considered the application and the arguments presented by both parties. The applicant sought to correct minor typographical errors in the agreement. The Commission noted that these errors did not affect the substance or the fairness of the agreement. The Commission was satisfied that the corrections were minor and did not alter the meaning or effect of the agreement. The Commission approved the corrections and confirmed the agreement's approval.

As a result, the Skilled Workforce Solutions (NSW) Pty Ltd Enterprise Agreement 2014 was approved with the corrections. The agreement will operate from 5 February 2014, and its nominal expiry date is 4 February 2017. The Commission's decision ensures that the agreement remains valid and enforceable, with the necessary corrections in place.
