CaseChat Overview and Summary

Singh (the applicant) sought judicial review of a decision by the Minister for Immigration (the respondent) to refuse to grant him a visa. The applicant had applied for a Protection Visa (Class XA) under s 36 of the *Migration Act 1958* (Cth). The Minister's delegate had refused the application, and this decision was affirmed by the Refugee Review Tribunal (RRT). The applicant then sought review of the RRT's decision in the Federal Court.

The primary legal issue before the Court was whether the RRT had erred in law by failing to consider, or adequately consider, the applicant's claims for protection based on a fear of persecution due to his membership of a particular social group. Specifically, the applicant argued that the RRT had not properly assessed his claim that he would be persecuted as a member of the social group comprising "young men who have been conscripted into the army and subsequently deserted." The applicant contended that the RRT had focused too narrowly on the general risk of conscription and desertion, rather than the specific risks faced by those who had already deserted.

Judge McNab found that the RRT had indeed failed to adequately consider the applicant's specific claims regarding the risks he would face upon return to his country of origin as a deserter. The RRT's decision had treated the applicant's situation as merely a risk of future conscription, rather than a present risk of persecution due to his past actions as a deserter. The Court held that the RRT was required to assess the specific dangers faced by individuals in the applicant's position, including the potential for punishment, discrimination, or other forms of persecution by state or non-state actors upon their return. The legal principle applied was that a decision-maker must engage with and assess all aspects of a protection claim, including the specific circumstances and risks faced by the applicant, rather than making generalised assessments.

The Court ordered that the RRT's decision be set aside and remitted to the RRT for redetermination according to law.
