Singh (Migration)

The Administrative Appeals Tribunal (AAT) considered an application by Mr. Singh for a Skilled (Provisional) (Class VC) visa, subclass 485 (Temporary Graduate). The primary dispute concerned whether Mr. Singh met the health criteria for the visa, specifically Public Interest Criterion 4005(1) as it applied to clause 485.216 of Schedule 2 to the Migration Regulations 1994.

The legal issue before the Tribunal was whether Mr. Singh satisfied the health requirements for the Temporary Graduate visa. The Tribunal was required to determine if the medical examination undertaken by Mr. Singh met the prescribed standards and if any adverse findings, if present, were adequately addressed or did not preclude him from meeting the criterion.

The Tribunal, constituted by Member Mary Sheargold, determined that a hearing was not necessary as it could resolve the matter based on the existing documentation. Applying section 360(2)(a) of the Migration Act 1958, the Tribunal found in favour of Mr. Singh. Consequently, the Tribunal remitted the application for reconsideration with a direction that Mr. Singh meets Public Interest Criterion 4005(1) for the purposes of clause 485.216 of Schedule 2 to the Regulations.
