The Tribunal noted that Mr. Singh had been provided with a copy of Ministerial Direction No. 69 and was asked to provide a statement addressing the issues within it. The Tribunal found that Mr. Singh's submitted statement did not address these issues, which it considered to be uncharacteristic of a genuine applicant. While Mr. Singh later provided answers to questions during the hearing that touched upon these issues, the Tribunal also noted inconsistencies in the information provided, including that Mr. Singh had studied on a visitor visa, had acquired a tax file number, and had undertaken vocational courses, without mentioning previous visa refusals. The Tribunal concluded that, based on the entirety of the circumstances and the lack of a satisfactory response to the GTE criteria, Mr. Singh had not satisfied the requirements.
