The Administrative Appeals Tribunal considered an application for a Skilled (Provisional) (Class VC) visa, Subclass 485, made by Mr. Singh, who nominated the occupation of Chef. The central dispute concerned whether Mr. Singh had satisfied the skills assessment requirement for this visa subclass.

Satisfied that this criterion was now met, the Tribunal concluded that the matter should be remitted for reconsideration. The Tribunal remitted the application for reconsideration, directing that the applicant meets the criteria under cl.485.224(1) of Schedule 2 to the Regulations.
