Although the applicant claimed indifference to this aspect of the application, the Tribunal determined that the provision of false information by an agent acting on the applicant's behalf engaged PIC 4020. The Tribunal also noted that the waiver provisions under PIC 4020(4) did not apply to the identity requirements, and while the applicant was given a fair opportunity to provide relevant information, this did not negate the initial contravention.

Consequently, the Tribunal affirmed the decision not to grant the applicant the Skilled (Provisional) (Class VC) visa, Subclass 485, as the applicant failed to meet the mandatory criteria.
