The Administrative Appeals Tribunal considered the case of Mr Singh, who held a Student (Temporary) (Class TU) visa, subclass 573. The dispute concerned the cancellation of Mr Singh's visa by the Department of Immigration and Border Protection. The primary issue was whether Mr Singh had breached a condition of his visa, thereby providing grounds for its cancellation.

The Tribunal was required to determine whether Mr Singh had complied with condition 8202 of Schedule 8 to the Migration Regulations 1994. The Tribunal found that Mr Singh had not been enrolled in a registered course of study for significant periods, including after receiving a Notice of Intention to Consider Cancellation. This failure constituted a breach of condition 8202(2)(a). In considering the discretion to cancel, the Tribunal noted that while Mr Singh claimed potential disappointment from his parents and personal shame, he acknowledged that he could study in India. The Tribunal also took into account the robust higher education system in India. The Tribunal concluded that the breach was significant and that Mr Singh's present intention was not to remain in Australia for the purpose of study.

Consequently, the Tribunal affirmed the decision to cancel Mr Singh's visa.
