After reviewing the evidence, the Tribunal concluded that there was no evidence that Mr Singh had provided a bogus document or information that was false or misleading in a material particular. The Tribunal noted that the definition of "bogus document" in section 5(1) of the Migration Act 1958 differs from the definition of "information that is false or misleading in a material particular" in PIC 4020(5), as the former does not require the false or misleading statement to be relevant to a visa grant criterion.
Consequently, the Tribunal remitted the application for reconsideration with a direction that Mr Singh met the requirements of PIC 4020 for the purposes of cl.885.224(a) of Schedule 2 to the Migration Regulations 1994.
