While Mr. Singh expressed a desire to complete his studies in Australia and potentially seek further temporary residence or return to India, the Tribunal found that the Subclass 485 visa was not designed for this purpose. The Tribunal was not satisfied that Mr. Singh had a compelling need to stay in Australia, as his stated primary reason for remaining was to study, for which a Student visa might be more appropriate. Although there were no known instances of non-compliance with visa conditions, the Tribunal concluded that, considering all circumstances, the visa should be cancelled.

Consequently, the Tribunal affirmed the decision to cancel Mr. Singh's Subclass 485 (Temporary Graduate) visa.
