The Administrative Appeals Tribunal considered the case of Mr Singh, an Indian citizen whose Subclass 500 (Student) visa was cancelled by the Department of Home Affairs. The cancellation was based on Mr Singh's conviction for domestic violence offences and criminal damage, for which he received community-based orders and a fine. Mr Singh sought a review of this decision by the Tribunal.

The Tribunal found that the ground for cancellation under section 116(1)(g) was established, as Mr Singh had been convicted of offences against Commonwealth, State, or Territory law, as prescribed by regulation 2.43(1)(oa) of the Migration Regulations 1994. While this ground did not mandate cancellation, the Tribunal then considered whether to exercise its discretion. The Tribunal had regard to the applicant's stated reasons for wishing to remain in Australia, including supporting his wife and reuniting with his daughter. However, the Tribunal noted inconsistencies in the applicant's account regarding his living arrangements and the circumstances of his daughter's residence in India. The Tribunal also considered the wife's alleged letters of support, which appeared to be in the same handwriting as the applicant's own signed letter and one was unsigned.

Ultimately, the Tribunal concluded that, considering all the circumstances, the decision to cancel Mr Singh's visa should be affirmed.
