Singh (Migration)

The Administrative Appeals Tribunal considered an application for a Skilled (Provisional) (Class VC) visa, Subclass 485 (Temporary Graduate), made by Mr. Singh. The dispute concerned whether Mr. Singh met the criteria for the visa, particularly in light of his criminal history. The decision was made by Member Mary Sheargold.

The primary legal issue before the Tribunal was whether Mr. Singh satisfied the requirements of Regulation 2.03AA(2)(a) and clause 485.216(1) of Schedule 2 to the Migration Regulations 1994, in relation to Public Interest Criterion 4001, despite his criminal history.

The Tribunal determined that a hearing was not necessary, as it could resolve the matter based on the existing material. It found that Mr. Singh met the specified criteria. Consequently, the Tribunal remitted the application for reconsideration with a direction that Mr. Singh be found to meet the relevant criteria for the Subclass 485 visa.
