Simms and Simms

In the matter of *Simms and Simms*, heard by Cronin J, the proceedings concerned applications for interim and final orders in a family law dispute. The wife had filed an application for interim orders on 8 January 2016, and the husband had also made an oral application for interim orders on 3 February 2016. The wife had also filed an application for final orders on 8 January 2016, to which the husband had filed a response.

The court was required to determine the applications for interim orders made by both parties, and to make directions regarding the adjourned applications for final orders. Specifically, the court had to consider which of the wife's interim orders should be granted, withdrawn, or dismissed, and whether the husband's interim orders should be struck out.

Cronin J dismissed the husband's application for costs of the interim proceedings. The court permitted the withdrawal of several paragraphs of the wife's interim orders application, and dismissed other paragraphs of that application. The interim orders sought by the husband were struck out. The applications for final orders by both parties were adjourned to a Registrar's directions hearing. The court certified that it was reasonable to engage counsel to attend the proceedings.
