Silver and Silver

In the District Court, Ms Silver sought leave to institute proceedings against Mr Silver. Ms Silver also made a supplementary application seeking that Mr Silver be dealt with for contempt of court.

The court was required to determine whether Ms Silver should be granted leave to institute proceedings. Additionally, the court had to consider whether there was sufficient cause to deal with Mr Silver for contempt of court.

The court dismissed Ms Silver's application for leave to institute proceedings, finding no cause shown. Similarly, the supplementary application concerning contempt was dismissed for want of cause. The court further indicated that even if leave were not required for Ms Silver's applications, they would be summarily dismissed.
